Terms of Use

These conditions apply whenever you visit, read, or use Colfax County Criminal History or submit a query through a search tool. By continuing, you agree to all terms below. Do not use the website if you do not accept them.

NO FCRA USE. This privately owned website is not linked to any government body. It and its advertising partners do not offer a consumer-reporting service for credit, employment, tenant, insurance, or other decisions regulated by the Fair Credit Reporting Act. The site only helps users locate criminal-record resources for Colfax County and New Mexico. It is neither a consumer reporting agency nor a private investigation firm.

1. What This Website Is

Colfax County Criminal History is a private reference site with no government affiliation. It cannot retrieve official files, conduct official checks, keep government criminal records, or submit documents for a visitor.

Its purpose is to route readers to custodians such as the Colfax County sheriff, Eighth Judicial District and magistrate courts, New Mexico Department of Public Safety, and New Mexico DPS Sex Offender Registry. New Mexico IPRA, Sections 14-2-1 through 14-2-12 NMSA 1978, controls access to records held by public bodies. Section 29-10-6 NMSA 1978 controls a person's inspection of their own DPS arrest record. Those official laws do not turn this private site into a records custodian.

2. Rules for Using This Site

Use must remain lawful and must not interfere with the service or another person. You agree not to:

  • Violate a federal, New Mexico, or local law
  • Threaten, harass, or stalk anyone using information found here
  • Use the content for an FCRA-regulated decision
  • Attempt unauthorized entry into any system
  • Deploy scrapers, bots, or automated collection tools against the pages
  • Disrupt access, performance, or availability for other users

3. No Harassment, Stalking, or Discrimination

Information reached through this site may not be used to harass, stalk, threaten, intimidate, or discriminate against anyone. The restriction is especially important for New Mexico DPS Sex Offender Registry information. Sections 29-11A-1 et seq. NMSA 1978 govern registry publication and misuse, and unlawful conduct against a listed person may carry criminal consequences. Registry data is released for public safety awareness, not vigilantism or blacklisting.

4. We Are Not a Consumer Reporting Agency

Neither this site nor its advertising partners create consumer reports, credit reports, or background reports for FCRA purposes. You must not use site content or a linked tool to decide:

  • Whether someone receives credit or a change in credit terms
  • Whether a person is hired, retained, or dismissed
  • Whether an applicant receives housing
  • What insurance rate or eligibility applies
  • Whether a person receives a license, permit, or government benefit

Any check required for a regulated purpose must come from an authorized official process or a screening provider that complies with the FCRA. This website cannot satisfy that need.

5. No Legal Advice

The material is general information, not legal advice. It cannot determine how New Mexico law applies to a Colfax County charge, conviction, warrant, expungement request, or other personal circumstance. Seek a licensed New Mexico attorney for legal guidance.

6. No Warranties

All material and services are offered "as is." No promise is made that:

  • Information is complete, accurate, or current
  • The site will remain available without interruption
  • Pages are free of defects or security weaknesses
  • A partner tool will return complete or correct results

Charges, dispositions, restrictions, addresses, hours, and fees change. Content here is not an official statement from Colfax County, a court, the sheriff, or New Mexico government.

7. Third-Party Services and Links

Links can lead to government offices, court systems, legal resources, and independent search services. Their operators control availability, content, pricing, terms, and data practices. We have no responsibility for those outside services. Review their terms before use.

8. Intellectual Property

Text, graphics, logos, and code belong to Colfax County Criminal History or its content partners. They may not be copied, modified, redistributed, or used to create another work without prior written permission.

9. Limits on Our Liability

To the greatest extent allowed by law, we are not liable for loss or damage arising from use of the site, reliance on its content, or use of any linked service.

10. Indemnification

You agree to protect and hold us harmless from claims, demands, actions, costs, and legal fees arising from your use of the website or your breach of these terms.

11. Governing Law

New Mexico law governs these terms. Any dispute tied to website use must be brought in a court located in New Mexico.

12. Changes to These Terms

These conditions may be revised at any time. A revision takes effect when the updated terms are posted here.

13. Cutting Off Access

Access may be restricted or ended at any time, for any reason, and without advance notice.

14. Severability

If one term is found invalid or unenforceable, the remaining terms continue in force. The affected clause is adjusted only as far as needed to make it enforceable.

15. Questions

Questions about these terms may be submitted through the Contact page.
